You can submit a VA disability benefits claim for Obstructive Sleep Apnea secondary to sinusitis if you are a veteran who has Chronic sinusitis because of the increased risk you have of developing it.

Is Sinusitis a VA Disability?

Yes, sinusitis qualifies as a VA disability, and based on how severe your symptoms are, it may be given a rating of 0%, 10%, 30%, or 50%.

To qualify for the VA disability benefits claim, your disorder must be deemed "Chronic."

Under CFR 38, Part 4, Diagnostic code 6510, VA Schedule of Ratings, Sinusitis, Pansinusitis, Chronic, the VA rates sinusitis.

How Do You Get a Sinusitis VA Rating?

Veterans can obtain a Sinusitis (Chronic) VA disability rating in one of three ways:

  1. Direct Service Connection for Sinusitis with an evaluation of 0%, 10%, 30%, or 50% indicates that you got sinusitis due to an incident, an injury, or a condition related to your military service.
  2. Secondary Service Connection for Sinusitis is also considered with an evaluation of 0%, 10%, 30%, or 50%. For instance, a veteran may receive a rating for secondary sinusitis due to a deviated septum.
  3. A 0%, 10%, 30%, or 50% rating indicates sinusitis is "Presumptive" to burn pit exposure. The VA assumes that burn pits cause sinusitis if you have served in the Gulf War region during the presumptive period. The Persian Gulf War, ranging from 9th September 2001 to the current, OR the Southwest Asia theatre of operations, from 2nd August 1990 to the present, constitutes the presumed period for particulate matter exposure.

To be eligible for presumed VA benefits, you must have experienced sinusitis within ten years of leaving active-duty military service.
